Q: Where should employee I-9s be retained?
A: The Immigration Reform and Control Act (IRCA) require employers to retain I-9 Employment Eligibility Verification Forms for all employees hired after November 6, 1986 and for certain former employees. Some states may require employers to complete additional paperwork.
Employers may find it useful to retain I-9 forms according to the following method:
File 1: I-9s for all current, active employees, stored alphabetically
File 2: I-9s for former employees required to be retained, stored chronologically
File 3: I-9s for employees with expiring work authorization or other special cases
File 4: I-9 policies and procedures
