Q. Does the Homeland Security Act affect an employer’s hiring of foreign nationals?
A. Yes, the Homeland Security Act changes the processes and time lines for both the immigration and enforcement aspects of the foreign workers entering and staying in the United States. On March 1, 2003, the Immigration and Naturalization Service became part of the new Department of Homeland Security. The Bureau of Citizenship and Immigration Services (BCIS) now handles all immigration services and benefits and the Bureau of Immigration and Customs Enforcement (BICE) will focus on the enforcement of immigration and customs laws within the United States.
