Q: What is appropriate corrective action?
A: Where inappropriate or possibly unlawful behavior is found, employers are expected to take action that will stop the behavior from occurring again. The action should be roughly proportionate to seriousness of the misconduct. Termination of the accused is not necessarily required. If the accused employee remains employed, however, the employer must closely monitor the work environment to assure that there is no repeat of the behavior and no retaliation. The employers should follow up with the complaining employee for this purpose and document the employee’s response. Reports of continued behavior or retaliation must be investigated and corrective action taken.
